These Terms of Use (“Terms”) govern your access to and use of psychogenx.com and related PsychogenX webpages that link to these Terms (collectively, the “Website”).
The Website is operated by Bradley Gruner under the PsychogenX name (“PsychogenX,” “we,” “us,” or “our”). By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.
1. Website Scope
These Terms apply to the Website. Individual PsychogenX applications, courses, simulations, subscription services, or other products may be governed by additional or separate terms. Product-specific terms control when they conflict with these Website Terms concerning that product.
2. Educational and Informational Purpose
PsychogenX provides educational information, reflective tools, training resources, and decision-support materials based on psychological science. Website content is provided for general educational and informational purposes.
The Website does not provide psychological or medical treatment, diagnosis, crisis care, legal advice, or individualized professional services. Website content is not a substitute for advice or services from a qualified professional who understands your circumstances.

3. No Professional Relationship
Accessing the Website, using Website materials, or communicating with PsychogenX does not by itself create a psychologist-patient, therapist-client, physician-patient, attorney-client, supervisor-trainee, fiduciary, or other professional relationship.
Descriptions of credentials, experience, or professional background do not mean that individualized professional services are being provided through the Website.
4. Artificial Intelligence and Personalized Content
Some PsychogenX products or materials may use artificial intelligence to generate questions, summaries, reflections, simulations, or other content. AI-generated content may be incomplete, inaccurate, biased, or inappropriate for a particular person or situation.
AI-generated material is information to consider, not a diagnosis, professional judgment, prediction, instruction, or substitute for human judgment. You remain responsible for evaluating information and making your own decisions.
Do not rely on PsychogenX or an AI feature as the sole basis for decisions involving safety, health, treatment, relationships, education, employment, legal rights, finances, or other significant matters.
5. Emergencies and Safety
PsychogenX is not an emergency or crisis-response service. Website communications may not be monitored continuously, and PsychogenX cannot contact emergency services on your behalf.
If you believe that you or another person may be in immediate danger, contact local emergency services or an appropriate crisis resource in your location.
PsychogenX tools are not designed to determine whether conduct constitutes abuse, coercive control, stalking, or immediate danger. When safety may be at risk, prioritize direct assistance from an appropriate local professional, emergency service, or specialized support organization.
6. Eligibility and Minors
The Website is not directed to children under 13. You may not knowingly submit personal information through the Website on behalf of a child under 13 unless legally required authorization has been obtained.
If you are under the age of majority where you live, you should use the Website only with the involvement and permission of a parent or legal guardian. Individual products may impose higher minimum-age requirements. Perfect Partner is intended only for adults aged 18 or older.

The Website and its original text, graphics, designs, logos, audiovisual materials, software, organization, and other content are owned by or licensed to PsychogenX and are protected by applicable intellectual-property laws.
Subject to these Terms, PsychogenX grants you a limited, revocable, nonexclusive, nontransferable license to access the Website and use its publicly available materials for personal, noncommercial, educational purposes.
Unless permitted by law or written authorization, you may not reproduce, republish, sell, license, distribute, modify, create derivative commercial products from, or remove ownership notices from Website content.
Nothing in these Terms is intended to restrict fair use or another right that cannot lawfully be waived.
“PsychogenX,” associated logos, product names, and related branding may be trademarks or service marks. No license to use them is granted except as expressly stated in writing.
9. User Communications and Submissions
You retain ownership of original content you submit to PsychogenX. By submitting an inquiry, suggestion, or other communication, you authorize us to use and process it as reasonably necessary to respond, provide requested services, operate and improve PsychogenX, maintain records, protect rights, and comply with law.
Do not submit content that you do not have the right to disclose. Do not send confidential clinical records or other highly sensitive information through ordinary Website email links or general forms.
Unless we expressly agree otherwise in writing, unsolicited suggestions, concepts, or ideas are not submitted in confidence and do not create a fiduciary or compensation obligation.
10. Third-Party Links and Services
The Website may link to third-party websites, application stores, research, media, platforms, or services. Links are provided for convenience or context and do not necessarily constitute endorsement.
PsychogenX does not control and is not responsible for third-party content, availability, security, terms, or privacy practices. Your use of third-party services is governed by their terms and policies.

We may modify, suspend, remove, or discontinue Website content or features at any time. We do not guarantee that the Website will always be available, secure, error-free, or compatible with every device or browser.
We may restrict or terminate access when reasonably necessary to protect the Website, enforce these Terms, comply with law, or address misuse.
12. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
TO THE FULLEST EXTENT PERMITTED BY LAW, PSYCHOGENX DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
PsychogenX does not warrant that content is complete, current, error-free, or suitable for your individual circumstances, or that use of the Website will produce a particular outcome.
Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PSYCHOGENX AND ITS OWNERS, CONTRIBUTORS, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, REVENUE, PROFITS, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THE WEBSITE.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF PSYCHOGENX ARISING FROM OR RELATED TO YOUR USE OF THE WEBSITE WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID PSYCHOGENX SPECIFICALLY FOR THE WEBSITE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED U.S. DOLLARS.
These limitations do not exclude liability that cannot lawfully be excluded or limited. They also do not alter any nonwaivable consumer right.
14. Responsibility for Your Decisions
You are responsible for how you interpret and use Website information. PsychogenX does not control your decisions, communications, relationships, professional practice, or actions taken in reliance on Website materials.
A disclaimer does not make unsupported, unlawful, or harmful use appropriate. You must use reasonable judgment and seek qualified assistance when circumstances call for individualized professional evaluation.
15. Governing Law and Venue
These Terms are governed by the laws of the State of Nevada and applicable federal law, without regard to conflict-of-laws principles.
Subject to any nonwaivable right to bring a claim elsewhere, legal proceedings arising from these Terms or the Website must be brought in a state or federal court of competent jurisdiction located in Nevada. You and PsychogenX consent to the personal jurisdiction of those courts.
These Terms do not require arbitration and do not contain a class-action waiver.
16. Changes to These Terms
We may update these Terms as the Website, our services, or applicable requirements change. Revised Terms will be posted on this page with an updated “Last updated” date.
Changes apply prospectively unless otherwise stated or required by law. Continued use of the Website after revised Terms become effective constitutes acceptance of the revised Terms.
17. General Provisions
If a provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue in effect.
Failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our written consent.
These Terms, the Privacy Policy, and the Educational Disclaimer constitute the applicable agreement concerning use of the Website, except where separate product-specific terms apply.
